Gryphon Collects grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your personal, non-commercial use in accordance with these Terms.

You agree not to:

• Attempt to gain unauthorized access to any portion of the Site or any related systems;
• Transmit any viruses, malware, or other harmful code;
• Scrape, harvest, or collect data from the Site without our written consent;

Gryphon Collects reserves the right to terminate your access to the Site at any time, for any reason, without notice.

By using the Site, you may provide us with personal information including your name, email address, shipping address, and payment information. You represent and warrant that all information you provide is accurate, current, and complete.

Gryphon Collects uses the information you provide to process orders, communicate with you about your purchases, send shipping notifications, and improve the Site. By providing your email address, you consent to receiving transactional emails related to your orders and account. You may opt out of non-transactional marketing emails at any time.

To make purchases on the Site, you must create an account or check out as a guest. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must be at least 18 years of age to create an account or purchase Products on this Site. By creating an account or making a purchase, you represent and warrant that you are 18 years of age or older.

You agree to notify Gryphon Collects immediately of any unauthorized use of your account. Gryphon Collects is not liable for any loss or damage arising from your failure to maintain the security of your account.

Gryphon Collects reserves the right to suspend or terminate any account that it reasonably believes has violated these Terms.

The Site may contain links to third-party websites or services, including social media platforms, live streaming platforms, payment processors, and shipping carriers. These links are provided for your convenience only.

Gryphon Collects does not control, endorse, or assume responsibility for any third-party websites or their content, privacy practices, or terms. Your use of any third-party site is governed by that site's own terms and policies. We encourage you to review the terms and privacy policies of any third-party sites you visit.

Gryphon Collects reserves the right, in its sole discretion, to cancel, modify, suspend, or discontinue any break, product listing, promotion, or service at any time, with or without notice, and without liability to you.

In the event that a break is cancelled by Gryphon Collects prior to being conducted, all participants who purchased spots in that break will receive a full refund to their original payment method. Refunds for cancelled breaks are typically processed within 5 to 10 business days, depending on your payment provider.

Gryphon Collects also reserves the right to correct pricing errors, remove product listings, or refuse service to any customer, at its sole discretion.

All prices on the Site are listed in U.S. Dollars. Gryphon Collects reserves the right to change prices at any time without prior notice. Prices in effect at the time your order is placed will apply to that order.

Payment is due in full at the time of purchase. We accept all major credit cards, debit cards, and other payment methods as indicated at checkout. All payments are processed through our secure, PCI-compliant payment processor. Gryphon Collects does not directly store, process, or transmit cardholder data on our own servers.

By submitting a payment, you authorize Gryphon Collects to charge the full amount of your order to the payment method you provide. If your payment cannot be processed, your order will not be fulfilled and you will be notified.

All sales are final. Once a spot has been purchased and confirmed, no returns, exchanges, or refunds will be issued, except in the following circumstances:

• Cancelled Break: If Gryphon Collects cancels a break for any reason, all participants receive a full refund.
• Damaged in Transit: If your cards arrive damaged due to shipping, you must contact us within 7 days of delivery with photographs of the damage. We will assess the claim and determine an appropriate resolution, which may include a partial credit or replacement.

Card contents are determined by the manufacturer. The specific cards included in a product and the allocation of cards to each team or spot are determined entirely by the manufacturer of the sealed product. Gryphon Collects makes no representation or guarantee regarding the specific cards that will be contained in any product. Market values of cards received may differ from the price paid for a spot. No refunds will be issued based on the cards received or their market value.

By purchasing a spot, you acknowledge that you are purchasing your team's or slot's allocation from a manufacturer-sealed retail product, and that the specific cards in that allocation are determined solely by the manufacturer.

We use industry-standard PCI-compliant payment processors. We do not directly store, process, or transmit cardholder data on our own servers. All payment processing is handled by our PCI DSS Level 1 certified payment processor. Your card details are entered directly into our payment processor's secure, encrypted environment.

You agree to indemnify, defend, and hold harmless Gryphon Collects, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms;
• Your use of the Site or any Products purchased through the Site;
• Any content you submit, post, or transmit through the Site;
• Your violation of any third-party right, including any intellectual property or privacy right.

The Site and all of its content, features, and functionality — including but not limited to text, graphics, logos, images, video, audio, and software — are owned by or licensed to Gryphon Collects and are protected by copyright, trademark, and other intellectual property laws of the Commonwealth of Virginia and the United States.

The "Gryphon Collects" name, logo, and all related marks are trademarks of Gryphon Collects. You may not use any of our trademarks without our prior written consent.

Nothing in these Terms grants you any right, title, or interest in the Site or any of its content beyond the limited license set forth in Section 1.

Gryphon Collects respects the intellectual property rights of others and expects users to do the same. If you believe that material on the Site infringes your copyright, please send a written notice to gryphoncollects@gmail.com with the following information:

• A description of the copyrighted work you claim has been infringed;
• The URL or specific location on the Site where the allegedly infringing material is located;
• Your name, address, telephone number, and email address;
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner;
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf;
• Your physical or electronic signature.

THE SITE AND ALL PRODUCTS AND SERVICES OFFERED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. GRYPHON COLLECTS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

GRYPHON COLLECTS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. GRYPHON COLLECTS DOES NOT WARRANT THAT THE RESULTS OF USING THE SITE WILL MEET YOUR EXPECTATIONS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GRYPHON COLLECTS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, PRODUCTS, OR THESE TERMS, EVEN IF GRYPHON COLLECTS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL GRYPHON COLLECTS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO GRYPHON COLLECTS IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

These Terms and any dispute arising out of or related to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Virginia Beach, Virginia, and the parties hereby consent to the personal jurisdiction and venue of such courts.

You agree that any dispute arising out of or relating to these Terms or the Site will be resolved on an individual basis and not as part of a class, collective, or representative action. You hereby waive any right to bring or participate in any class action lawsuit or proceeding.
